    Re-selling Quark 8

    I have a full copy of Quark 8 Xpress of which I got for my self for freelance work in July.

    However since this date I have started working for a company that uses Quark and is updating all the versions to Quark 8 very shortly. When this happens I have been offered to use the works version on my laptop for overtime use, (which is allowed under the license).

    This will mean I have a full version of Quark 8 I would like to sell so I can use the funds for much needed design kit.

    Can anyone tell if this is possible as the Quark license I received from quark came with my name attached along with the serial number, I also have the box and disc - I have had this software running on my machine but will be uninstalling my license and inputing the works license.

    Will my version need to be reset or can I re-sell straight away?

    Probably the best option too. Consider the hassle if someone on the forum gave you some inacurate advise and you had to deal with some angry person who bought your copy and had to jump through some unforseen hoops. I'm sure you'd rather make the sale and be done with it.

    I'm pretty sure that by law companies have to let you re-sell software. But like everyone says ask them!

    yer your right, i want to sell it but i wouldn't want to stitch anyone up as I would hate it if it was done to me. Thanks for your replies

    All you have to do is phone quark sales tell them your intention, they send a form you fill it in then its done that copy is transfered to the new owner. I did this myself a little while ago relly easy

    mmmm interesting I just tried calling Quark and some strange man told me that this was not possible unless it was a company take over or a family member. Sounds very silly to me, surely as I own this copy I'm entitled to pass it on to some one else in a legal manor.

    I agree that you should be able to sell it and transfer the license, as long as its not part of an upgrade path that you are currently using. By that, I only mean that if you had bought, for example, a full version of Quark 4 ten years ago, and paid an upgrade price for your Quark 8. It seems to me that someone buying your copy has the potential to become a loyal customer into the future, and because so few of us never pass files off to printers and service bureaus, another user in the mix would only be good for Quark to sell copies to others. I think its worth another call. Maybe talk to a supervisor if you don't get any luck with the person you get on the phone the next time.

     And be very clear to them that you won't be keeping a copy on your computer.

    As per the "Global End User License Agreement" the End User is granted a non-exclusive, non-transferable License to USE the SOFTWARE and documentation subject to the restrictions and terms set forth in this License Agreement. End User shall not assign or transfer this License Agreement, or any part thereof, whether directly or indirectly.

    But the OP isn't asking to transfer the license himself, he is asking what procedure would be acceptable for the company to transfer the licence themselves.

    There is a difference between the owner of the software (Quark, Inc.) disallowing a user (the original poster) from transferring the license, and the owner (Quark, Inc.) transferring the license themselves. The company isn't out any money, because they already have it. The OP won't have the program, so he won't have something he didn't pay for, and the new owner will have the copy that has been paid for. How is this bad for anyone? You can even make the case that the original EULA has been honored, since the end user didn't transfer the license, the owner (Quark, Inc.) did.

    They've changed their policy on transfers. Last year I bought a previously owned copy of XPress and had ownership transfered to me without problem.

    Thanks for finding that, that was information I needed.


    I have to say its frankly ridiculous that I cant sell something that I own and want to sell on..... it would also explain why there are so many pirate versions available.

    personally I'd just go ahead and sell it, its not your fault quark have a stupid policy in place!
