I never experienced it myself and have not heard anyone else facing it either. In case you get that again, could you please try closing the layer palette and open it again. You may also try creating a new document after getting layer palette in that state and see if you can create new layers then.

Could you please post details like QuarkXPress version, OS in use. Does that happen with all documents or some specific files?

It's probably text boxes that are on a layer that's turned off. I've had weird things happening with Layers, like text boxes that are on a turned off layer would show in a printout.
